    California FTB Bank Levy

    Your account is frozen and the clock is already running. This is the one that has to be handled today.

    The Direct Answer

    The California Franchise Tax Board can freeze your bank account without suing you. The document is called an Order to Withhold. Your bank receives it, holds the funds on deposit, and sends them to the state when the holding period stated on the order ends. Nobody calls you first.

    An IRS bank levy generally allows 21 days. A California withholding order may carry a different holding period, and the instructions and deadlines printed on the order control. If you found this page because your card was declined this morning, treat it as a same-day problem.

    The funds in the account at the moment the order is served are what the levy captures. Money deposited afterward generally is not covered by that specific order, but nothing prevents the FTB from issuing another one, and for people with payroll direct deposit that is exactly what tends to happen.

    What Actually Gets a Levy Released

    Speed

    The request has to reach the right unit before the holding period on your order closes. After the bank remits, you are asking for a refund instead of a release, and that is a different and slower fight.

    Documented Hardship

    Rent, payroll, medical costs, and the specific consequence of losing the funds. Assertions do not move the state. Statements, bills, and dates do.

    Exempt Funds

    Social Security, disability, and certain benefit deposits can be protected, but you have to trace them in the account rather than simply claim them.

    A Real Arrangement

    Filing the missing years and putting an acceptable agreement in place is what stops the next order from being issued a month later.

    Where the Balance Came From

    A large share of California levies trace back to a year that was never filed. The FTB builds a Notice of Proposed Assessment from third party income reports with no deductions and no expenses, that estimate becomes final when nobody protests it, and enforcement follows. Filing an accurate return for those years is frequently what cuts the number down, and it is a step most people skip because the levy has their full attention.

    This is also why California cases need the federal picture pulled at the same time. If the FTB found you, the IRS usually has the same unfiled years on its own list.
